Regulations of the Shop "Sleziak - frame mouldings".

The following Terms and Conditions of the store define the rules for the use of the online store "Sleziak - frame mouldings" available at: https://sleziak.com.pl/regulamin-1467/, the terms and conditions of sale and the scope of responsibility related to the sale. The use of the online store "Sleziak - framing slats" requires reading and acceptance of the following Regulations and may be carried out only to the extent and on the terms specified therein. The provisions of these Regulations do not exclude or limit any rights of consumers under the mandatory provisions of law. All provisions of these Regulations, the application of which is excluded in contracts concluded with consumers, are applicable in contracts concluded with entrepreneurs.


I. General Provisions

  1. The online store "Sleziak - frame slats", hereinafter referred to in the Terms and Conditions as the Seller, is a company store operated by professionals, at the address:

  2. Manufacturer names and factory brands belong to their owners and are presented on the store's pages for informational purposes only.

  3. Any person using the online store "Sleziak - frame slats" is its User.

  4. The user is obliged to read the content of these Terms and Conditions, accept its provisions and is bound by its provisions in each case at the time of ordering.

  5. The sales contract is concluded between the User and the Seller.

  6. The contract of sale of goods is concluded in accordance with Polish law.

  7. All formats of frames, frames and moldings in the online store "Sleziak - frame moldings" are given as internal, unless the Seller explicitly states otherwise. Internal dimension means the format of a picture, photo, etc., which fits into the light (center) of the frame.


II. Placing an order

  1. Orders are accepted through the online store "Sleziak - frame mouldings" located at: www.sleziak.com.pl
  2. Orders placed by phone or email will not be processed.

  4. A necessary condition for the fulfillment of the order is the provision of a true residential address and telephone number by the User. In case of suspicion of providing false data, as well as in case of impossibility to contact the User, resulting from the sole fault of the User, the Seller reserves the right not to send the goods.
  5. After placing an order, the User gets a confirmation to the indicated e-mail address that the order has been accepted for processing and receives an individual ID that will apply to the placed order.
  6. When placing an order, the User selects the method of delivery and form of payment. In the case of selected goods, the Seller will inform the User about the possibility of excluding some forms of delivery.
  7. A user placing a non-standard or individual order (e.g., making a frame, frames with their own specific dimensions, making a selection of their own gallery design, multigallery, changing the format of passe-partout) is required to contact the Seller in advance (at 34 34 3448585 or e-mail: biuro@sleziak.com.pl) in order to present the details of the order and the Seller's ability to execute the order. If there is no contact, the Seller has no possibility to execute the order and the payment will be returned.
  8. The price of goods shown on the website of the online store "Sleziak - frame mouldings" is binding at the time of placing an order by the User.
  9. The Seller reserves the right to make changes in the prices of goods, conduct and cancel promotional actions and sales or make changes in them. The above entitlement does not affect the prices of goods in orders placed before the effective date of the price change, terms of promotional actions or sales.

III. Order execution

  1. The Seller shall process placed orders on business days and hours, in the order in which they are received.
  2. Execution of the accepted order begins:
    a) in the case of orders paid by bank transfer - when the funds are received and credited to the Seller's account,
    b) in the case of orders paid by PayU - when the funds are received and credited to the Seller's account.
  3. The estimated lead time is from 24 hours to 14 business days. The seller reserves the right to extend the lead time once, related to unexpected difficulties.
  4. The seller may refuse to process orders that are questionable, i.e. where the phone number or e-mail address is missing. These are necessary to confirm the order.
  5. The vendor may refuse to fulfill orders with difficult or impossible execution of goods.
  6. When the User selects the payment option - paid in advance, if the payment is not made within 7 days of the order, the Seller has the right to cancel the order.
  7. The seller will process the order only if the goods are available in stock or from the store's suppliers. In case of unavailability of some of the goods covered by the order, the User is informed about the status of the order. The User has the opportunity to decide how the order will be fulfilled within 5 working days of being informed by the Seller - partial fulfillment, extension of the waiting time, cancellation of the entire order. If the User does not communicate the decision to the Seller within the specified period, the order will be canceled.
  8. The user may make changes to the order until the start of order processing. If the user cancels the order after the time of its execution by the Seller, he is obliged to pay all costs made by the Seller. In particular, this applies to products that are made to order, which are already in the production stage.
  9. The Seller does not provide the User with a warranty for the purchased goods and is liable only within the limits provided by law. Warranty in relations with non-consumers is excluded within the limits provided by law.
  10. The user, in the event of cancellation of an order that has already been shipped, shall bear all costs made by the Seller.
  11. In the case of customized products, the Seller informs that the dimensional tolerance may be up to 2 mm.
  12. Ordered products are delivered to Users via courier service to the address indicated in the order form.
  13. We issue a VAT invoice or receipt for each order.
  14. The VAT invoice is issued no later than the 7th day after the delivery of goods or performance of services. The conversion of a receipt into a VAT invoice is possible within the above period.
  15. Delivery of goods is carried out in the manner selected by the User and specified in the order.
  16. Delivery of goods takes place in the territory of the Republic of Poland.
  17. Delivery to the countries of the European Union is possible after individual determination of its terms by contacting the User with the Seller via e-mail with an indication in the title of the e-mail: "inquiry as to the possibility of delivery to the EU".

IV. Shipping costs

  1. The cost of shipping depends on the value of the order, the size and weight of the goods, the materials used to package and secure the goods, the payment method, the delivery method and the destination country.
  2. The fee associated with the shipment is included in the price of one of the items on the invoice.
  3. The cost of shipping is paid by the User, unless otherwise indicated by the Seller.
  4. Prices of products do not include the cost of delivery of the order, unless there is a description next to the product: "free delivery".

V. Delivery time

  1. The time in which the User will receive the ordered goods is the lead time and the expected delivery time.
  2. Standard lead time is 3-4 business days, the customer is informed by phone or e-mail about changes in lead time or inability to complete the order.
  3. With a high volume of orders during the holiday season, the lead time may be extended, of which the Seller will inform the Buyer.
  4. The lead time for custom orders can take up to 14 business days.
  5. The date of personal collection of shipments is agreed individually with the Seller.
  6. Shipments are delivered Monday through Friday from 9 am to 5 pm.
  7. Shipments delivered by courier company: delivery time 1-2 business days.
  8. The seller informs that it has no control over possible delays or irregularities in delivery made by the courier company.

VI. Payments

  1. All prices include VAT. The price listed next to each item is binding at the time the User places an order.
  2. The user can choose the following forms of payment for the ordered goods:
    a) by bank transfer to the store's account,
    b) in the PayU payment system - the amount due is collected when the order is placed.
  3. In the case of larger orders, the Seller has the right to extend the lead time, of which it will inform the Buyer in advance.
  4. Shipments outside the country can only be paid by PayU or bank transfer, by prior arrangement with the Seller.
  5. In the case of non-payment for the ordered goods within 7 days from the date of order and no contact with the User, the Seller has the right to cancel the order.
  6. In the case of services with characteristics specified by the User in the order placed by him or strictly related to his person (so-called individual orders), they are payable only in advance.

VII. Complaints

  1. In the event of damage and defects on the goods, arising during delivery or to address a complaint directly to the Seller, the User should send back the defective product to the address provided by the Seller.
  2. The Seller informs that, in accordance with the Postal Law, a claim for improper performance of the postal service expires as a result of acceptance of the postal item without reservation, unless the loss or damage to the postal item, which is not outwardly noticeable, is discovered by the User after acceptance of the postal item and, no later than 7 days after its acceptance, the User has notified the postal operator of a claim on this account and proved that the loss or damage to the postal item occurred during the time between acceptance of the postal item by the postal operator for the performance of the postal service and its delivery to the addressee.
  3. In connection with paragraph 2, the Seller informs that in the event of damage to the shipment or defects, the User should draw up an appropriate protocol in the presence of the courier, which will contain true data and will be drawn up in accordance with the facts. Failure to raise objections within the legally stipulated period or failure to prepare the protocol may result in the expiration of claims directed by the User to the Seller.
  4. All complaints are processed no later than within 7 working days of receipt.
  5. Once the complaint is accepted, the Seller will send full-quality goods or other goods from the offer. If this is not possible, the Seller will refund the User. The refund of the money paid will be made to the User's bank account.
  6. After the complaint is accepted, the Seller will reimburse the User for the costs associated with the return of the advertised goods.
  7. If the supplier finds damage to the goods as a result of improper delivery, the Seller will not be held liable for damage to the goods.

VIII. Withdrawal from the contract

  1. The Seller informs that the right to withdraw from the contract within 14 days, from the date of receipt of the shipment, in accordance with the Law of May 30, 2014. "On consumer rights", the consumer has the right to withdraw from the contract without giving any reason and without incurring costs except:
    - additional costs incurred by the Buyer who has chosen a method of delivery other than the cheapest, ordinary way of delivering the item offered by the Seller,
    - direct costs of returning the item.
  2. The right of withdrawal from a contract concluded at a distance does not apply to the consumer when the subject of the performance is a non-refabricated item, produced to the consumer's specifications or intended to meet his individual needs.
  3. The consumer may withdraw from the contract by submitting a statement of withdrawal to the Seller. To meet the 14-day deadline it is sufficient to send the statement before its expiration.
  4. The Seller will refund the payment using the same method of payment used by the Consumer, unless the Consumer agrees to a different method of refund.
  5. The Consumer is obliged to return the item to the Seller immediately, but no later than 14 days from the day on which he withdrew from the contract. The Seller may withhold reimbursement of payments received from the Consumer until it receives the item back or the Consumer provides proof of its return.
  6. The Consumer's withdrawal form is included in the email that the Buyer will receive from the Seller after the purchase (concerning the ordered goods).

IX. Responsibility of the Parties

  1. The seller shall be liable to the buyer if the consumer goods are not in conformity with the contract at the time of delivery.
  2. In the case of individual agreement on the characteristics of consumer goods, they are presumed to be in conformity with the contract if they correspond to the description given by the seller or have the characteristics of the sample or sample shown to the buyer, as well as if they are suitable for the purpose specified by the buyer at the conclusion of the contract, unless the seller has raised objections to such purpose of the goods.
  3. The seller is not liable for non-conformity of consumer goods with the contract if the Buyer, at the time of the conclusion of the contract, knew or, judging reasonably, should have known of this non-conformity. The same applies to nonconformity that resulted from a cause inherent in the material supplied by the Buyer.
  4. The seller is not responsible for the goods if the color of the delivered goods may slightly differ from the colors shown in the photos due to the individual settings of the monitors, shade, grain or absorption of the wood used.
  5. The Seller is not responsible for frames, frames and other similar goods that the User himself decides to paint, decorate, etc.
  6. The vendor is not responsible if the material supplied by the user contains defects, defects, errors of the previous contractor.
  7. If the User requests a service to replace a part of the material (e.g., glass, frame), in case of failure to return the replaced parts - components, the parts - components are removed by the Seller.

X. Protection of Customers' personal data

  1. All personal data obtained in the course of the service's activities are confidential. Under no circumstances or in any form will they be disclosed to other persons or other entities, in accordance with the Law of August 29, 1997. "On the Protection of Personal Data." In accordance with this law, Users have the right to inspect their data, to correct them and to request that they cease using them.
  2. The provision of any data by the User is voluntary.
  3. At the time of ordering the purchase of goods, the User will receive messages from the Seller regarding the completion/status of the order. The Seller may also contact the User by phone or electronically to provide important information regarding the order or to verify the order.

XI. Final Provisions

  1. Amendments to the Regulations will be made in the event of changes in applicable laws and court rulings.
  2. A change in the Terms and Conditions may not cause negative consequences on the part of the User. The Seller will each time inform by e-mail the Users who are consumers and are directly affected by the change of the Terms and Conditions.
  3. The user bears the risk of providing an e-mail address to which he does not have access, in particular an incorrect address or one belonging to another entity, and the resulting consequences of not receiving notification of changes to the Terms and Conditions.
  4. The Seller is not responsible for damages incurred by the User, caused by threats occurring on the Internet, in particular, hacking into the User's system, interception of passwords by third parties or infecting the User's system with viruses.
  5. A user who is a Consumer has the right to use out-of-court procedures for handling complaints and pursuing claims. Detailed information and rules of access to these procedures are available at the offices and websites of district (city) consumer ombudsmen, social organizations whose statutory tasks include consumer protection and at the following Internet addresses:

  6. The competent court for disputes arising in connection with the conclusion, performance, termination, cancellation of the contract, as well as for compensation due to non-performance or improper performance of the contract shall be the court having jurisdiction over the performance of the contract.
